UCAB supports strengthening of criminal responsibility for dangerous foods turnover
Amendments to existing legislation on safety and quality of foods that are actively initiated recently, greatly enhance the responsibility for dangerous foods turnover. The Association "Ukrainian Agribusiness Club" supports such initiatives.
Under the turnover the market entry, storage and sale of food products is meant. In particular, if the product caused slight harm to consumers, market operators are to be fined to the amount of 4 thousand UAH. If the injury, caused by such a product, may be classified as a moderately severe, the liable undergoes restriction or deprivation of liberty for a term of two to five years. In case of death of the victim, caused by consumption of such a product, the liable may be imprisoned for a term of five to ten years.
"Until now the turnover of dangerous foods and the legal consequences that follow from this are not regulated separately by the Criminal Code of Ukraine, - the Executive Director of UCAB Oleksandr Verzhykhovslyi says. – Responsibility is applied in general for an intentional market entry of dangerous products in Ukraine and presupposes a fine from 1700 to 3400 UAH or correctional labor for up to two years with deprivation of the right to occupy certain positions or be engaged in certain activities for a term up to three years. That means that a clear interpretation of guilt and punishment, depending on the level of harm caused to the victim, is completely absent. This is undisputedly wrong, when it comes to food products, consumption of which is directly related to the health of citizens."
The Association "Ukrainian Agribusiness Club" supports legislative initiatives aimed to strengthen responsibility for the turnover of dangerous foods, especially since it will affect not only the producers and salers of such products, but also the regulatory authorities, acts or omissions of which led to the presense of unsafe food on the table of the consumer.
