ARZINGER successfully represented a Ukrainian subsidiary of a French agricultural group in FOSFA arbitration
ARZINGER represented a client in dispute with an Italian buyer who failed to pay for the supplied goods. The team proved the case for payment of the unpaid balance of the purchase price and the interest.
There was also an interesting battle for the client's legal costs – as many of you know, in commodity arbitrations, it may be quite difficult to get legal costs awarded even if the applicablerules allow arbitrators to do so.
After dealing with certain procedural difficulties, the team also secured that the Tribunal directed the respondent to pay 100% of the client's legal costs.
