Ukraine: the court partially sustained the claim of Nibulon for distribution of the grain export quotas
The Nikolayev district administrative court partially sustained the claim of one of the largest Ukrainian producers and exporter of agricultural commodities, Agricultural Limited Liability Company Nibulon Ltd., sued against the two Ukrainian Ministries concerning legitimacy of grains export quotas distribution on January 11, 2011, according to the decision of the court dd. March 30, 2011.
According to the decision, the Nikolayev district administrative court rendered unlawful and resolved to cancel the decision of the State Inspection on agricultural commodities quality controlling and market monitoring for refusal in acknowledgment of the documents, provided by Nibulon Ltd. to the Ministry of Agrarian Policy, concerning provision of the conclusion on presence of the declared volumes of agricultural products oriented for exports, and the opportunity to realize the export operations of nearly 264 thsd tonnes of maize and 276 thsd tonnes of wheat. Besides, the court rendered unlawful the inactivity of the Ministry of Agrarian Policy as to the Ministry did not inform the company on refusal in provision of the conclusion on presence of the required volumes of agricultural products. As a reminder, Nibulon Ltd. sued against the Ministry of Economy, the Ministry of Agrarian Policy and the State Inspection on agricultural commodities quality controlling and market monitoring, litigating the company exclusion to the quotas imposition for wheat and maize exports. During grains export quotas distribution on January 11, 2011, grain export leaders of the previous years were not able to receive them – Cargill, Toepfer, Louis Dreyfus, Soufflet Group and Nibulon.
