Ukraine: experts of the Verkhovna Rada have the range of remarks to the draft law #8321

 The position of the draft law #8321 “On making of amendments to the Tax Codex of Ukraine and adoption of tariffs of the export duties for several varieties of grains”, which includes plans for imposition of the export duties for wheat and meslin, barley and maize, calls criticism from the Main scientific-and-expert department of the Verkhovna Rada, according to the findings of the department dd. April 19, 2011.

In particular, the position of the draft law does not come in accordance with standards of the article XXVIII bis of the General Agreement on Tariffs and Trade (GATT) of 1994, which specifies the duties as the serious barriers for trading.

Besides, imposition of the export duties for several varieties of grains does not completely agree with the current Grains Trade Convention (GTC, 1995).

The statement of the draft law on excluding of all commodities, mentioned in the document, from the regime of free trade with other countries contradicts to standards of bilateral agreements on free trading, concluded with the CIS countries and Georgia.

The explanatory note to the draft law does not include supporting information on the general expedience of the parallel using of export duties and quotas towards grain trading, which will possibly take place during the particular period of time. The accompanied documentation does not provide the clear reasoning for rates of the specified tariffs of the export duties.
