The Committee recommends to adopt the draft of the agricultural receipts
It is proposed by the project # 9610 to establish such an alternative method of credit the agricultural manufacturers as credits, secured by the future crop. In particular, the authors of the project define the agricultural receipt to be a document that sets the unconditional obligation of the debtor's receipt of shipping, referred in this document, of agricultural production, quality, quantity, location and time of delivery. This receipt must be notarized. Information about all activities concerning the agricultural receipts is recorded in a special Register.
Availability of agricultural receipts, without a mark on its implementation is sufficient proof of indisputable claims of such creditor's receipt.
In addition, the project is determined that while avoidance of fulfill obligations of the agrarian receipt for person who issued it, if it has caused property damage to others, is to be punished by imprisonment for a term not exceeding three years, or restraint of liberty for the same term or a fine of one hundred to two hundred untaxed minimum incomes of citizens.
As mentioned in the discussion, agrarian receipt “is essentially a promise to supply agricultural products or to make payment after the sale of agricultural products in future in return for getting resources (financial or commodity) at the time of receipts issuance for business activities”.
In the opinion of members of the committee, adoption of the draft will solve the problem of agricultural producers crediting, especially small and medium-sized, which do not have enough liquid assets for collateral, other than property rights for the next crop of young farm animals.
