President against Government-proposed mechanism to assure payments balance equilibrium
In his letter to Premier Yuliya Tymoshenko (promulgated by President press-service Apr 27/09), President Viktor Yushchenko says he is against mechanism proposed by Cabinet in draft Law “About Bringing Changes into Some Ukrainian Laws regarding Ukrainian Payments Balance Condition Regulation” (registered under ¹ 4262), targeted at finding national goods producers efficient protection methods and assuring State payments balance equilibrium.
In part., President admits this draft Law gives Cabinet right to approve list of goods whose import to Ukrainian customs territory is to be imposed with additional import duty as well as additional import duty collection procedure. Besides, President says draft Law also grants Cabinet right to fix additional import duty rates in per cent against imported goods customs value and establish additional import duty gradual shortening/cancelling schedule.
Besides, in his letter President also says that Ukrainian Constitution sets principle of taxes/fees (as well as their rates/payments) legislative establishing and therefore adoption of Cabinet Decree on additional import duty introduction, shortening, canceling and prolonging in form of legislative act doesn’t correspond to articles 67 and 92 of Ukrainian Constitution.
It is to be reminded, due to same reasons President submitted (Feb 26/09) to Ukrainian Constitutional Court Constitutional Presentation ¹1-1/408 on recognizing some provisions of Ukrainian Laws “About Ukrainian Customs Tariff” and “About External Economic Activity” unconstitutional, − as these provisions granted to Ukrainian Government overwhelming majority of abovementioned rights.
